Petroleum Institutions

Section 12 of the Petroleum Act, 2019 establishes the National Upstream Petroleum Advisory Committee (NUPAC). NUPAC generally advises the Cabinet Secretary on upstream petroleum operations. These include advice on negotiation of and entering into petroleum agreements, suspension, revocation or termination of a petroleum agreement or the recall of a security given under the terms and conditions of a petroleum agreement.

NUPAC is chaired by the Principal Secretary, Ministry of Petroleum and Mining and the Director-General of EPRA is the Secretary. Other members include the Attorney-General, Principal Secretary, the National Treasury and Planning, Director-General, National Environment Management Authority, Council of Governors, Commissioner-General, Kenya Revenue Authority, Chief Executive Officer, National Oil Corporation and the Commissioner of Petroleum (or their representatives).

 

Established under section 25 of the Energy Act, 2019, the Energy and Petroleum Tribunal is mandated to hear and determine energy and petroleum disputes. The Tribunal deals with appeals of decisions made by the Energy and Petroleum Regulatory Authority (EPRA). Disputes between a licensee and a third party or between licensees are also handled by the Tribunal. Parties have a right to appeal the Tribunal's decisions in the High Court of Kenya.
